The 435th District
Court is a newly created Court by the Texas Legislature, which is
different from every District Court in the State of Texas. This
Court will be the only District Court in Texas that will hear cases
involving the civil commitment of violent sexual predators (“VSPs”).
Typically, District Courts cover only the County in which they sit
in; however, the 435th District Court theoretically
covers every County in the State of Texas. Therefore, these VSPs
will not only come from Montgomery County, but ever County in the
State of Texas.
With respect to these
civil commitment cases, the Defendants appearing before the 435th
District Court will be VSP inmates at the end of their stay with the
Texas Department of Corrections system where they were sentenced to
prison for sex crimes. More specifically, these Defendants will be
repeat offenders and considered VSPs. At the end of the civil trial
of these cases, a jury will determine if the Defendant qualifies as
a VSP and whether or not, if released, would probably commit another
sex crime. If the jury answers both of these questions “yes”, then
the VSP once released from TDC will be committed to a halfway house
somewhere in Texas with special restrictions set by the Judge on a
case by case basis. More importantly, a GPS tracking system will be
attached to these VSPs to monitor their location and activities.
Violation of the Judge’s special restrictions and/or tampering with
the GPS tracking device can result in this VSP being charged with a
Third Degree Felony and being sent back to TDC.
Therefore, the Texas
Legislature created the 435th District Court to provide
for civil commitment and tracking of VSPs instead of them being
released out on the street at the end of their TDC stay.
Furthermore, my duty in this Court is to provide for the protection
of the citizens of Montgomery County and the State of Texas.
I will have 20 years of
Civil Trial Experience as of June 2008, where I have represented
“PEOPLE” - individuals, families and the small business owner. A
review of my Community Involvement activities for the last 20 years
evidences that I have served the “PEOPLE”, especially our youth of
Montgomery County. Again, it is my position that the 435th
District Court was created to protect the “PEOPLE” of Montgomery
County and the State of Texas. To continue my service to the
“PEOPLE”, I would now like to serve as your elected public official
of this Court. Therefore, I would appreciate your VOTE for Judge of
the extremely important 435th District Court.
